CONTRATAÇÕES ANORMALMENTE BAIXAS EM LICITAÇÕES E A OCORRÊNCIA DO WINNER’S CURSE: ESTADO-DA-ARTE

O superfaturamento de obras públicas vem sendo amplamente discutido tanto pelos órgãos de controle quanto pela mídia no Brasil, contudo, existe um outro problema igualmente relevante, porém menos enfocado: a contratação de obras por preços inexequíveis com valores muito baixos e a ocorrência da maldição-do-vencedor ou winner’s curse. As consequências são igualmente negativas, afetando a sociedade com prejuízos financeiros e sociais, como: obras de baixa qualidade, entregues com atraso ou até mesmo abandonadas. Diante desta problemática, o objetivo do presente trabalho é levantar como o winner’s curse tem sido abordado em trabalhos acadêmicos no nível nacional e internacional e quais as posturas mitigadoras da sua ocorrência. Para tanto, foi utilizado o método SystematicSearchFlow proposto por Ferenhof e Fernandes (2016), sendo selecionadas vinte e nove publicações desde 1996 até 2020. Os principais requisitos a serem observados no processo licitatório para evitar o winner’s curse foram elencados e podem servir de base para estudos futuros em obras públicas brasileiras, aprimorando o atual processo licitatório.
