Guidelines for claims management in large-scale construction projects in Brazil

Abstract

Given the complexity of contracts and the high cost of litigation in large-scale projects in the Brazilian civil construction industry, there arises an urgent need for efficient claims management. Effective claims management contributes to the efficient resolution of disputes, ensuring the maintenance of the economic-financial balance of contracts and the promotion of collaborative relationships between the parties. The identified procedures contributed to the avoidance of arbitration, reduction in legal costs, continuity of the works, maintenance of the contractual relationship, and improvement in communication. This work presents the results of case studies regarding claims management, with reference to the performance of a project management company. Based on this analysis, some guidelines were delineated and are briefly presented. They establish a collaborative framework in which multiple disciplines can work together for a more effective outcome and an equitable distribution of responsibilities.
